NON-SOLICITATION

 

Non-solicitation refers to section 6 of the tutor agreement:

6.1 The Subcontractor is not bound by any exclusivity agreements – they are free to obtain their own private clients or work for other tutoring companies, however it must be understood that students provided by the Company remain clients of the Company at all times.

6.2 The Subcontractor agrees that following the termination of this Agreement it will not accept any appointment or engagement with, or otherwise render any services to the Client for a period of twelve months.

6.3 Any attempt to breach clause 6.1 or 6.2 will result in immediate dismissal and a recoverable charge of $2000 per student that will be enforceable by law.

We do everything possible to make Alchemy an incredible place to work. We offer great benefits, a ton of freedom and a supportive community that looks great on a resume. We ask you respect this by honouring our non-solicitation clause and understanding that Alchemy students remain students of Alchemy at all times.

You are free to tutor your own students privately and work with other companies if you wish, but you need to respect the work that has gone in to building relationships with the families we support and ensure that any students assigned to you by Alchemy remain under the covering of Alchemy.

This extends beyond your time with us – even if you decide to cease tutoring, any attempt to contact your student and work with them privately will be seen as a breach of contract and will be pursued.

We take this very seriously and have taken previous tutors to court as a result. As a sub-contractor you are your own business, so this is a business relationship – it doesn’t matter if you are only young and don’t have money, as a business to business relationship the contract we enter is binding and you will still be liable if pursued.

We appreciate your adherance to our non-solicitation clause.

NIC'S HOT TIP:

We are a super fun place to work but we do take this very seriously.

In 2018 we had one particular tutor attempt to take 8 students privately. We have a number of technical protocols in place to identify if and when this is happening and as a result we took her to court costing her thousands of dollars.

We view this the same as taking merchandise from a store you work at or cash out of the register. We have a zero tolerance policy and will pursue you if it happens.

As long as you stay on the right side of this clause you are going to love working here!
